Uttarakhand Chief Minister Pushkar Singh Dhami, in an informal interaction with the media, clarified that the anti-copying law has been brought to prevent cheating and rigging in competitive examinations conducted for state government recruitments. The Chief Minister made it clear that this law would apply only to competitive examinations conducted for government recruitment. This will not be applicable in the examinations of schools and degree colleges.
According to the CM, the law department had recommended its implementation in schools as well, which the government has refused to accept. Told that some people are spreading rumors regarding the scope of the law, whereas in the notification of the ordinance itself, it has been clarified on which examinations this law will apply.
Recently the governor had given approval
It is noteworthy that in Uttarakhand, Governor Lieutenant General (Seni) Gurmeet Singh had approved the Uttarakhand Competitive Examination (Measures for Prevention and Prevention of Unfair Means in Recruitment) Ordinance 2023. With this, this ordinance has come into force in the state. Earlier, to ensure transparency and fairness in competitive examinations in Uttarakhand state, on February 9, 2023, the Uttarakhand Competitive Examination (Measures for Prevention and Prevention of Unfair Means in Recruitment) Ordinance 2023 was approved by Chief Minister Pushkar Singh Dhami and sent to the Governor. was forwarded for approval. Strict provisions have been made against the culprits in this ordinance.
Stringent punishment
According to this ordinance, if any person, printing press, service provider organization, management system, coaching institute etc. is found involved in unfair means, then a provision has been made for imprisonment up to life imprisonment and a fine of up to ten crore rupees. If a person conspires with an organization conducting organized examination, then provision has been made for punishment up to life imprisonment and fine up to Rs 10 crore.
If a candidate is found to be indulging in unfair means in a competitive examination either by copying himself or by making other candidates copy, then a provision has been made for imprisonment of three years and a fine of minimum five lakhs. If that candidate is found guilty again in other competitive examination, then a provision has been made for imprisonment of minimum ten years and fine of minimum 10 lakhs.
If any examinee is found cheating, a provision has been made to debar him for two to five years from the date of filing of the charge sheet and in case of conviction, to be debarred from all competitive examinations for ten years. If a candidate is found cheating again, provision has been made to debar him from all competitive examinations for five to ten years and for life respectively. The property acquired by using unfair means will be attached. The offense under this act will be cognizable, non-bailable and non-compoundable.
Papers leaked in examinations, that’s why this ordinance was needed
This ordinance was necessitated when cases of copying and paper leaks came to the fore in many competitive examinations. Significantly, a complaint was made to the CM on behalf of the delegation of the unemployed union in Uttarakhand. He demanded action by handing over a memorandum to Chief Minister Pushkar Singh Dhami regarding irregularities in the graduate level examination held on December 4 and 5, 2021, on behalf of the Uttarakhand Subordinate Services Selection Commission. On this, following the instructions of Chief Minister Pushkar Singh Dhami, DGP Ashok Kumar handed over the investigation to the STF regarding irregularities in the recruitment examination. Six youths were first arrested by the Special Task Force of the Uttarakhand Police in connection with the examination malpractices.
In this case Rs 37.10 lakh cash was recovered from one of the accused. Which was taken by him from different students. A total of 43 people have been arrested in this case so far. This includes the BJP leader, who has been expelled by the party for six years. A total of 94.79 lakh cash has been recovered so far in the examination recruitment case. In this case, more than two dozen bank accounts have been frozen. In which an amount of about thirty lakhs is deposited. In such a situation, many examinations were canceled.
At the same time, the conduct of the examinations was given to the Uttarakhand Public Service Commission. Cases of paper leak have also come to the fore in the examinations of the commission. In these, the Lekhpal, Patwari exams have also been cancelled. At the same time, arrests are also being made in the case of paper leak in JE and AE exams. One of the accused is also a BJP leader.
